Our Site provides information regarding our custom shade solutions, products, engineering, permitting, fabrication, installation, and maintenance services (collectively, “Services”). The content on this Site, including product guides, galleries, and portfolio representations, is provided for informational and promotional purposes to help you plan your project.
2. Digital Estimates, Quotes, & Contracts
Any quote requests or digital estimates submitted or received via this Site are preliminary inquiries.
- A digital estimate or quote provided via the Site does not constitute a legally binding contract to perform work.
- Binding agreements for custom fabrication, engineering, and installation require a separate, signed physical or electronic contract outlining specific project scopes, payment milestones, engineering variables, and structural dimensions.
3. Intellectual Property Rights
The Site and its entire contents, features, and functionality—including but not limited to all CAD drawings, project photographs, design styles, text, logos, graphics, and the structural arrangement thereof—are owned by Miami Awning or its licensors and are protected by United States and international copyright, trademark, and other intellectual property laws.
- Miami Awning® is a registered trademark. You may not use our branding, logo, or proprietary product photos without explicit, written consent.
- You may download or print product brochures or guides provided on the Site strictly for personal, non-commercial use related to evaluating a potential project with us.
4. Permitting, Engineering, & Field Conditions
For users evaluating project scopes through our Site, please note that local service delivery is subject to the following regulatory constraints:
- Permitting & Zoning: While Miami Awning provides permitting services, structural approvals are subject to the absolute discretion of South Florida municipal and county building departments. Miami Awning is not liable for project delays stemming from municipal processing queues, zoning changes, or localized building code revisions.
- Structural Integrity: Customer warrants that any existing structure to which a Miami Awning product is to be attached is structurally sound and capable of bearing the calculated loads.
5. Weather, Maintenance, & Hurricane Preparation
Shade structures and fabric awnings require adherence to specific maintenance and safety protocols.
- Hurricane Protocols: It is the customer’s responsibility to follow provided guidelines regarding retractable awnings, curtains, or removable fabric skins ahead of named tropical storms or hurricane events. Miami Awning provides maintenance and hurricane preparation guidance via the Site, but cannot guarantee immediate emergency removal services for all clients simultaneously immediately preceding a storm.
- Limitation of Weather Liability: Miami Awning is not liable for structural or fabric damage resulting from Acts of God, including but not limited to hurricanes, tornadoes, windstorms exceeding rated engineering specifications, or lightning strikes.
6. User Conduct & Form Submissions
When using our “Request a Quote” or communication forms, you agree to provide true, accurate, and current information. You are prohibited from using the Site to submit misleading data, impersonate others, or transmit malicious code, viruses, or scrapers designed to disrupt our digital architecture.
7. Limitation of Liability
To the maximum extent permitted by applicable law, Miami Awning, its officers, employees, or digital agents (including TyTech LLC) shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of, or inability to use, the digital Site.
While we strive to keep information, paint samples, fabric colors, and technical specifications on the Site accurate and up to date, variations may occur based on monitor calibration or manufacturer supply changes. Website content is provided on an “as-is” and “as-available” basis without warranties of any kind.
8. Governing Law & Dispute Resolution
These Terms and your use of the Site shall be governed by and construed in accordance with the laws of the State of Florida, without giving effect to any choice or conflict of law provision.
